Terms of Service

1. Acceptance of Terms

By creating an account or using any part of the PostNotes service, you confirm that you are at least 18 years old and agree to be bound by these Terms of Service. If you do not agree, you must not use the service.

2. Beta / Pre-Launch Status

PostNotes is currently in a pre-launch (beta) phase and is not yet offered commercially. During this phase:

• The service is provided free of charge and without availability guarantees; features may change or be discontinued as we prepare for launch.
• We may reset, migrate, or restructure accounts and stored content where technically necessary, and will give notice by email where reasonably possible.
• You should not yet rely on PostNotes as the only copy of anything irreplaceable — please keep your own copies of important messages and credentials.
• Provisions of these Terms that describe paid upgrades, physical card shipping, and longevity guarantees describe the intended commercial service and take full effect at commercial launch.

We will announce the end of the beta phase, and these Terms will be updated accordingly.

3. Description of Service

PostNotes is a secure, privacy-focused platform that allows users to compose personal legacy messages that are stored and only disclosed to designated recipients after a configurable confirmation process is completed. The service includes a web-based message editor, client-side encryption, a multi-agent confirmation workflow, optional proof-of-life check-ins, a password vault, public memorial pages, status updates, optional AI and social-media farewell features, physical card packages, and a free tier that can be expanded through one-time purchases.

4. Account Registration & Authentication

You register with an email address and sign in either with a one-time magic link sent to that address or with a password you set, powered by Supabase. You are responsible for:

• Keeping your credentials confidential.
• All activity occurring under your account.
• Notifying us immediately of any unauthorized access.

We offer optional two-factor authentication (authenticator apps and passkeys), which we strongly recommend enabling.

5. Purchases & Payments

PostNotes has no subscriptions. The service is free to start; paid upgrades are one-time purchases. All payment processing is handled by Stripe, a third-party payment processor. We do not store your full card details on our servers.

• Upgrades are applied to your account immediately upon purchase and remain in effect permanently; there is nothing to renew or cancel.
• You are never charged automatically. There is no auto-renewal and no stored recurring charge.
• Credits (for SMS/WhatsApp deliveries and AI conversations) are consumed by use and never expire.
• One-time purchases of physical goods (card packages) are non-refundable once fulfilled.
• Prices may change at any time; changes never affect purchases you have already made.

6. Free Tier

A free tier is available with limited storage and features. We reserve the right to modify or discontinue the free tier with reasonable notice. Free-tier accounts that have been inactive for 24 consecutive months may be deleted after prior email notification.

7. Message Storage & Encryption

Messages are stored as static content bundles in cloud object storage. You may choose to encrypt your messages client-side before they are uploaded:

• Zero-knowledge mode: Encryption and decryption occur entirely in your browser. We have no ability to read the content of encrypted messages. If you lose your password, the content cannot be recovered.
• Unencrypted mode: Messages are stored in plaintext on our infrastructure and are only ever rendered to you and, after disclosure, to your recipients.

You are responsible for safeguarding any encryption passwords. We accept no liability for content that becomes inaccessible due to lost passwords.

8. Confirmation Workflow & Message Disclosure

You designate one or more trusted confirmation agents who can initiate the disclosure process. Once the required number of agents trigger confirmation:

• You will be notified immediately via email, including the exact release time and instructions to cancel from your account.
• The default cancellation window is 48 hours and is configurable in your release settings. A confirmation may alternatively be configured to complete on a fixed date of your choosing.
• If you do not cancel within the window, your messages become publicly accessible via their permanent URLs.
• Once disclosed, messages remain accessible indefinitely, with a minimum guaranteed availability of two (2) years even in the event of company closure.
• If a disclosure was made in error, you may reverse it using the re-privatization link from your release notification, confirmed with your two-factor authentication.
• If you enable optional proof-of-life check-ins, repeatedly missed check-ins (after warnings by email and SMS) start this same confirmation process, subject to the same notification and cancellation rules.

You accept that the confirmation process is designed to operate automatically, and that failure to cancel within the designated window constitutes your consent to disclosure.

9. Physical Card Packages

Physical card packages (containing QR codes linked to your message URLs) are optional purchases. Cards are produced and dispatched by a third-party fulfillment provider. Delivery times and conditions are subject to that provider's terms. Once production begins, orders cannot be cancelled.

10. Content Responsibility

You are solely responsible for the content you store and disclose through PostNotes. We do not pre-screen or moderate message content. Content that violates these Terms or applicable law may be disabled or removed in response to a valid report or legal order, and will be reported to the appropriate authorities where the law requires it. Encrypted content is technically inaccessible to us and cannot be reviewed.

11. Prohibited Use

You may not use PostNotes to:

• Store, transmit, or disclose illegal content of any kind.
• Harass, threaten, or harm any individual.
• Circumvent security or access controls.
• Impersonate any person or entity.
• Use the service for commercial bulk messaging or spam.
• Attempt to reverse-engineer, scrape, or overload the platform.

Violation of these prohibitions may result in immediate account suspension and, where required, referral to law enforcement.

12. Third-Party Services

PostNotes relies on the following third-party service providers, each of which has its own terms and privacy policies:

• Supabase — authentication, database, and object storage.
• Stripe — payment processing for one-time purchases.
• Vercel — hosting and privacy-focused analytics.
• Email and SMS delivery providers — for confirmation workflow and notification communications.
• X (Twitter) — only if you connect an account for the optional social farewell feature.

We are not responsible for the practices, outages, or policy changes of these third parties.

13. Service Availability

We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where practicable. We are not liable for losses caused by outages, data loss, or service degradation.

14. Company Shutdown Procedure

In the event of company closure, we will provide at least six (6) months' notice where possible. All users will receive an export of their message bundles. Publicly disclosed messages will be mirrored for a minimum of two (2) years. Annual SD-card archives are prepared and can be distributed to users upon request.

15. Termination

You may request deletion of your account at any time before the confirmation lifecycle completes, by contacting us. Upon deletion:

• All message content and personal data will be permanently removed within 30 days.
• Already-disclosed (public) messages will remain accessible as they are considered voluntarily published content.

We may suspend or terminate accounts that violate these Terms, with or without notice, depending on the severity of the violation.

16. Limitation of Liability

To the maximum extent permitted by applicable law, PostNotes and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the service, including but not limited to: loss of data, loss of access to messages, or failure of the confirmation workflow due to circumstances outside our control.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email and/or a notice on the platform at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes will be resolved in the courts of competent jurisdiction. Nothing in these Terms limits your rights as a consumer under applicable local law.
